Terms and Conditions: Payment: 50%-100% payment deposit required for all payments made by check. Balance of payment due Net 15 days. If balance is not received 15 days prior to delivery, Images In Ice will assume the sculpture order has been cancelled and the deposit will be forfeited. Checks returned for Not Sufficient Funds will be charged a $20 service fee for each check attempted to be deposited. Any fees, penalties, and/or charges, including, but not limited to, attorney fees, court costs, etc., related to recovering payment will be at the customer’s expense. Late orders: Orders Placed within 1 week of the event are subject to a fee of $75-$150 fee depending on the complexity of design. All orders made by new customers must be paid in full prior to the event unless other arrangements have been made. Cancellation: There will be no refund for cancellations. However, your deposit may be held for another delivery date within one year of the original delivery date if arrangements have been made minimum 7 days prior to the original delivery date. Reschedule: A 10% reschedule fee will be charged for all reschedules made not less than forty-eight (48) hours a before the original scheduled delivery. The full deposit, in the case of a check deposit, and a 50% payment, will be forfeited by the customer for reschedules made within forty-eight (48) hours of the original scheduled delivery. Any reschedule that postpones delivery for more than forty-eight (48) hours from the original schedule date and time are considered “Cancelled”. All reschedules are subject to availability. Assumption of Liability: If the customer is not present at the time of delivery, the customer may authorize an onsite contacts to receive the product(s), and thereby assumes all responsibilities of this contract. If no onsite contact is is named or fails to dirrect the delivery team of Images In Ice, the customer assumes and excepts the set-up as is. Damages incurred by products rented from Images In Ice will be billed to the customer. Any damages incurred to the product(s) of Images In Ice, after delivery, are the responsibility of the customer. Table Conditions: It is the responsibility of the customer to provide a sturdy, even, flat, and level display structure capable of supporting a minimum of three hundred (500) pounds for a single-block product.* Display structure failure is not the responsibility of Images In Ice. The display structure’s minimum dimensions shall be sufficient to completely and independently support the product(s). Images In Ice may refuse set-up due to lack of customer providing a safe structure for set-up. If set-up is unsatisfactory to the customer in any way, the customer is entitled to a refund minus the cost of ice and delivery fee and Images In Ice will remove the sculpture(s) immediately. Environmental conditions and product design affect the rate at which the ice will melt. It is the responsibility of the customer to ensure that water discharge is captured and disposed of. Images In Ice is not responsible for any accident or injury that may be caused by the negligence of the customer in maintaining proper and timely disposal of water.† Product Design: Not All ice sculpture are the same, therefore the product shall meet the specifications of the customer, as provided by the customer. The design of the product is the responsibility of the customer. All rented property may only be used in regulation with the procedures outlined and dictated by Images In Ice. Upon delivery, the customer assumes all liability associated with the product(s), including, but not limited to, the actions of hospitality staff, guests, etc. Any negligence or misuse of the product(s) is wholly the responsibility of the customer. If the delivery or sculpture does not meet the expectations of the client, it is the responsibility and right of the client to ask for a full refund and removal the sculpture. Because ice is a temporary medium, any problems must be reported to Images In Ice immediately by telephone and picture text to 805-822-9828. If there is a problem that is not reported Images In Ice has the right to decide if any portion of payment is to be refunded. Any defecation of reputation and or slander of reputation that is unjustly inflicted on Images In Ice after any disagreements have been resolved will be fought by legal matters at the cost of the said client. Any Severance: If any portion of this contract is deemed unlawful or unenforceable, the remaining portions of the contract shall remain. *Multi-block products and ice fountains require additional support. Please speak with a customer service representative for product specifications. †A solid block of ice, in a shaded and wind-free environment at 72° Fahrenheit, will discharge approximately 5-gallons of water every 3 hours.
